Terms of Service

1. Agreement to Terms

By accessing adinflow.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to Webabi OÜ ("Company", "we", "our"), a company registered in Estonia.

2. Description of Service

AdInflow is an AI-powered SaaS platform that generates optimized Google Ads campaigns based on your business data. Our Service includes:

• AI-driven campaign structure generation
• Keyword research and optimization
• Ad copy creation using OpenAI/Anthropic APIs
• Google Ads account integration for analytics
• Campaign export in Google Ads compatible formats

3. Account Registration

• You must provide accurate, complete information during registration
• You are responsible for maintaining account security
• You must be 18+ years old to use the Service
• One account per user; no account sharing
• We reserve the right to suspend accounts for Terms violations

4. Subscription Plans & Billing

4.1 Free Trial

New users receive a 14-day free trial with limited features. No credit card required.

4.2 Paid Plans

Plans are billed monthly or annually:

• PRO Plan: $X/month — [features]
• SCALE Plan: $Y/month — [features]

4.3 Payment Processing

• Payments processed securely via Stripe
• You authorize automatic recurring charges
• Prices subject to change with 30 days notice
• All fees are non-refundable unless required by law

4.4 Subscription Changes

• Upgrades: Prorated charges applied immediately
• Downgrades: Takes effect at end of current billing period
• Cancellation: Access continues until end of paid period

4.5 Refund Policy

All sales are final. We do not provide refunds except:

• Service outage exceeding 72 consecutive hours (prorated credit)
• Billing errors (refund of incorrect charge)
• As required by applicable consumer protection laws

5. Google Ads Integration

5.1 Authorization

By connecting your Google Ads account, you grant AdInflow permission to:

• Access campaign performance data
• Read account structure and settings
• Generate campaigns based on your input

5.2 Your Responsibilities

• You retain full ownership of your Google Ads account
• You are responsible for reviewing generated campaigns before deployment
• We are not liable for campaign performance or ad spend
• You must comply with Google Ads policies

5.3 Disconnection

You may disconnect your Google Ads account at any time via Settings → Integrations. We will immediately revoke access and delete associated tokens.

6. AI-Generated Content

6.1 Content Accuracy

• AI-generated content is provided "as-is" without guarantees of accuracy
• You are responsible for reviewing and editing all output
• We do not guarantee compliance with advertising regulations (e.g., FTC, ASA)
• You must ensure content does not violate third-party intellectual property

6.2 Content Ownership

You own the campaigns and content generated using the Service. We do not claim rights to your output, but we retain the right to use anonymized, aggregated data for service improvement.

7. Prohibited Uses

You may NOT use the Service to:

• Violate laws or regulations
• Promote illegal products/services (drugs, weapons, etc.)
• Generate misleading or fraudulent advertising
• Reverse-engineer, scrape, or abuse the platform
• Share accounts or resell access
• Overload systems with excessive API calls
• Violate Google Ads Policies or third-party terms

8. Service Availability

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be announced in advance
• We are not liable for downtime caused by third-party services (Supabase, OpenAI, Google)

9. Intellectual Property

• AdInflow platform, code, and branding are owned by Webabi OÜ
• You may not copy, modify, or distribute our software
• Your business data remains your property (see Privacy Policy)

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Service provided "AS IS" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Total liability capped at fees paid in the 12 months preceding the claim
• We are not responsible for third-party services (Google Ads, AI providers)

11. Indemnification

You agree to indemnify Webabi OÜ against claims arising from:

• Your violation of these Terms
• Misuse of generated content
• Violation of third-party rights
• Non-compliance with advertising regulations

12. Termination

12.1 By You

Cancel your subscription at any time via Settings → Billing. Access continues until period end.

12.2 By Us

We may suspend/terminate accounts for:

• Terms violations
• Non-payment
• Fraudulent activity
• Legal requirements

12.3 Effect of Termination

• Access to Service immediately revoked
• Data retention per Privacy Policy (30-day grace period)
• No refunds for remaining subscription time

13. Changes to Terms

We may update these Terms with 30 days notice via email or in-app notification. Continued use constitutes acceptance. Material changes require explicit consent.

14. Governing Law

These Terms are governed by the laws of Estonia. Disputes resolved in Tallinn courts. EU residents retain consumer protection rights under local law.
